Samaria Rice has hired a lawyer after her son, Tamir E Rice, was killed by police while playing with a fake gun.

On Saturday at around 3:30 PM, a man called Ohio authorities after he saw a young boy walking around with a gun near a playground area next to Cuddell Recreation Center.

In the 911 call, the man told the dispatcher that he believes that the gun is fake. Here is a transcript of the call:

“I’m sitting in the park…there’s a guy here with a pistol, and it’s probably a fake one, but he’s pointing it at everybody.

The guy keeps pulling it in and out…it’s probably fake, but he’s scaring the shit out of people.”

Moments later, two officers – a rookie and a 10-15 year veteran arrived to the scene. The rookie, who witnessed Rice pick up the gun from a table and put it in his waistband, demanded that he put it down.

The young boy refused, which lead to the cop shooting him twice in the chest. The child was rushed to MetroHealth Medical Center in serious condition and he died early Sunday.

The boy’s mother, Samaria Rice, who lives across the street from the recreation center, said that she heard the shooting, but never imagined that her son was involved.

Rice claimed that the family did not own weapons and she does not understand why her son failed to listen to the cops. Rice has hired Tim Kucharski of the law firm Richardson & Kucharski to represent her. Kucharski said:

“Apparently, listening to the 911 call…the caller halfway across the part recognized that this was a toy gun. I’m not sure how police weren’t able to make that same decision. We’re going to conduct our own parallel investigation. I understand what police are putting out there, I cannot confirm or deny those facts. The family is absolutely is devastated. He was a wonderful young man. Our own investigation will begin as early as tomorrow.”

After the fatal shooting, police discovered that the boy was carrying an “airsoft”-type replica gun resembling a semi-automatic pistol.

Jeff Follmer, president of the Cleveland Police Patrolmen’s Association, said the officers were not told the caller thought the gun might be fake.

An investigation has been opened to find out why Samaria Rice lost her son due to a fake gun.
