The Illinois couple who is asking for $50,000 in damages claimed the classmate kicked, punched and threatened to kill Joaquin on a daily basis. Deveri Del Core stated that she was fired from Robert Frost Elementary school after filing the complaint.

Last week Matthew and Deveri Del Core who are the parents of Joaquin Del Core visited an Illinois court house where they filed a lawsuit against the third grader from Robert Frost Elementary school who has been allegedly bullying the child for several years.

Along with the bully, the parents also sued the school district, and the principal of Robert Frost Elementary school, Jeffrey Brusso and are asking for $50,000 in damages.

Mr and Mrs Del Core claimed in the documents from Cook County Circuit Court that the boy whose initials are C and A has been beating, kicking, punching and making death threats for numerous months.

The Del Cores’ lawyer Joel Handler stated that they have brought the matter to the authorities at Robert Frost Elementary school who failed to act.

The duo spoke to a local television station and explained that the physical and emotional pain inflicted by the bully cause their son to have nightmares :

“There was everything from him choking my son and threatening to kill him, said he was going to go home and get a knife and come back and kill him,’ said Deveri Del Core. ‘My son would wake up at night screaming and crying, terrified, and did not want to go to school.”

Matthew and Deveri Del Core revealed that parents of the little attacker claimed that he has anger issues and needs professional help.

In a strange turn of events Deveri DeL Core who worked in her son’s elementary school’s cafeteria was fired few hours after the lawsuit came to light.

Robert Frost Elementary school issued a statement saying denying that DeL Core lost her job in retaliation and promised to investigate the bullying incident.

The story has gone viral and has people debating on whether the parents are right to sue the bully or should they have put their son in self defense classes so he coul stand up to his tormentor.

I live in cloquet mn and the school dosnt do enything to kids that are bulling outher kids.I went to school bord meeting and called out the princple on it thay said that smoking and bulling has gone on for ever. It cant be stoped i said so that makes it ok. Of course i cant prove it because it was never put in the minutes of the meeting.I hope thay also go after the school and the princeple and school board. thay need to be held acountable. thay pertend thay dont now enything but thay do no parent would let there kid get bullied.

    1. the only thing to do is to sue as the schools all only give lip service and say that the students safety is their priority when the only priority is to not get sued by the bullies parents.

  3. This goes on all the time and it needs to be worked on. I think our systems are not taking it seriously enough!

  4. This has happened at my grandson’s school, too, and my grandson tried to intervene, but was punched in the stomach by the bullying student. I believe that the problem is rooted in the homes of the bullies; they are bullied by either parents or siblings and so they learn that it is normal to behave in that manner. There needs to be counseling for both the whole family before the bully is allowed back into school.

  5. It’s case by case. Bullying cases are never the same. I was bullied by my teachers because of a disorder I have and stuck in a closet in the school office every day so they wouldn’t have to deal with me. The school district pretended not to listen to my mom when she called every day demanding I be given proper attention and not shut away all day. Maybe standing up the bully is good, maybe it isn’t. I’m not sure about suing the bully; again, maybe, maybe not. Case by case, it’s difficult either way.
