CA Election Results 2010: Prop 19 Defeated
California Election Results 2010 have now been unveiled. A bill was proposed on Tuesday’s mid term election to authorize the sale of marijuana in the golden state has been defeated by the voters.
Proposition 19 which was put together by Richard Lee would have contributed 300 million dollars a year (according reports the marijuana industry is worth about 14 billion dollars annually) to the state which is scrambling to find the 21 billion dollars needed for its annual budget.
The legislature which would legalize marijuana for personal use was rejected by almost 54% of the voters who went to the boots, against the 46% who supported it.
The author of the initiative was hoping that marijuana would be sold freely in California to residents who are just over 21 years of age, with a tax going to the state tax and the sale of the drug would be regulated the same way that the sale of alcoholic beverages is controlled.
A dozen states already have laws that allow the sale of marijuana for medical purposes. California was the first state to pass a law for “compassionate use of marijuana” for the terminally ill and then 10 states, mostly western ones, followed the golden state.
The piece of legislation will be reintroduced in 2012 election.

Its really sad to hear that prop 19 didn’t pass, you know a lot of drug dealers probably voted against this so they won’t lose profit(thats a lot bank these dealers make), Seriously sucks that not enough voters voted yes. How are we ever going to get this gift from god ‘legal’?
I will tell you what….I was initially for this bill until I educated myself.
Come back with a bill that does the following and I will vote for it.
1. Does NOT allow cities or counties to ban medical marijuana.
2. Does NOT increase “regulation” of marijuana by the state.
3. Does NOT require expensive permits to gain ‘permission’ to grow from the state…only for large scale commercial vendors.
4. Allows unpermitted sale and trade of marijuana to any person without state authorization, as long as its done in private and not in a place of business.
5. Does not open medical marijuana and personal marijuana users to IRS persecution on the federal level through taxation.
6. Does not under any circumstances make marijuana MORE illegal, like if you smoke with somebody who is 18 but not 21…..currently a $100 ticket but becomes a an offense that will put you in prison if propped 19 passed.
Really, I think decriminalization is better….really, people talk about how its easier for students to get weed than alcohol like its a BAD THING?!!! Its NOT! Its better for kids to smoke weed than drink….so what kind of implied message is that sending? We want it to be easier for them to score meth or crack than weed now, by making it as hard to get as alcohol? I would rather have weed being sold on the black market to children, without an increase in punishment for that offense, than for them to turn to heavy narcotics and stimulants because its less regulated and potentially less severely punished compared to weed after the so called “legalization”.
So those are my reasons for rejecting prop 19. I am a medical marijuana patient with serious illness who actually NEEDS marijuana….I have cancer, Crohns and Multiple Sclerosis and am constantly in pain. Opiates alone dont cut it. I need medical marijuana and I cant afford to see the dispensaries shut down because prop 19 gives cities the right to tax medical marijuana clinics into non-existence. For me weed is already legal enough, and without my card its only a $100 ticket….unlike in other states, California is not locking people up for weed, and with the new decriminalization bill prop-19 becomes less necessary and in some cases actually makes things worse.
I am hoping for a better bill in 2012…..make it so that nobody gets arrested for using or selling it, even in large quantities, but stop trying to tax and regulate it…yeah, it would be good for the states budget but all the confusion of city laws with marijuana could open people up to even more serious marijuana charges because of the REGULATION of marijuana than they were subject to before it become “legal”….you have to ask yourself if that would really be a step forward.

I seriously can’t believe a fellow patient would be so selfish and naïve as to hold off until you get your perfect bill. It’s never going to be a perfect law, so we have to compromise in order to protect the most people possible.
Kids won’t do smack just because it’s a little harder for them to get weed.
I’m very disappointed in the outrageously flawed logic from people who didn’t vote for this bill. The only people who had a good reason for voting it down are police officers and the illegal suppliers.

Good points Maybe in 2012 it will be re-presented correctly and pass. Something simple that just makes it legal for every one over 21. Laws and taxation only for retail sales or commercial growing.

You were very misinformed! When Schwarzenegger signed SB 1449, that also would’ve applied to Prop 19. So, as of January 1, 2011, Regardless of whether Prop 19 would’ve passed or not, smoking with somone between 18 & 21 is automatically a $100 ticket. This was not so before, because SB 1449 was not in play. Prop 19 only stated that the existing laws on the books would be continued in regards to minors and smoking in public. And yes the current law stated that smoking around a minor is a misdemeanor punishable by 6 months in jail. But that law expires on January 1, 2011 regardless, because SB 1449 supersedes. And FYI, the $100 ticket law is still not in effect until January 1. If you are busted today, YOU WILL HAVE A CRIMINAL RECORD, whether you fight it or not.
1. Cities and counties banning medical marijuana? Banning production or possession? Possession will NEVER be illegal for medical anywhere in California. But several counties have banned storefront dispensaries, including my home county.
2. Prop 19 itself did not call for state regulation. But Tom Ammiano prepared ABX6-9 to pass through the assembly right after Prop 19 was voted on. And since you obviously didn’t read it, I’ll fill you in. ABX6-9 establshes a regulatory framework for Prop 19 and it calls for marijuana to be regulated through the California Department of Alcoholic Beverage Control. Of course you didn’t know that either.
3. Permits would’ve been issued on a city and county level according to whatever laws they establish. What is wrong with that? Possession would be legal everywhere, so why would you care about permits on a state level?

And yes I agree with the next paragraph. But nothing will ever completely end a black market on marijuana. And marijuana will not be any more or less accessible to kids than it already is. And that’s just plain common sense.
And reading the paragraph after that, you’re probably trollin’ hard! If you really have all of those conditions at once, then I’m sorry, but I find that extremely hard to believe. And if you would use marijuana with meditation and gain some spirituality, you would discover that you can actually heal yourself. And clinics don’t get taxed under Prop 19 and never will. WHERE DO YOU GET YOUR INFO FROM? PLEASE TELL ME!
And the next paragraph, possession of an ounce or less is legal under Prop 19. That simple. No county or state can change that. You obviously own a dispensary that stands to lose from more competition. Why else would YOU be concerned with the business side?

This is complete bullshit the government has screwed us over again. There is very few reasons that Marijuana should be illegal to begin with, it was all over racism and discrimination for the Mexicans who cultivated the plant back in 1917. The fact is that the only way that weed does or ever will hurt anyone is through its laws. The former drug czar even stated himself “the drug war is not winnable but it is directly fundable”. The federal government makes around $1200 a day for every inmate locked up in their system, so why would they want to legalize the most widely used drug in the world. In 1969 ( before Nixon started the DEA) the murder conviction rate was at 98%, in a 2008 pole the murder conviction rate dropped down to 62%, this is a direct result of the unjustified spending of the taxpayers money on something that could be making if not millions but billions of dollars for the U.S economy. I am not saying ( for the most part ) make it legal so everybody can get high, but the real question is who would you want the money being made off Marijuana to go to the American economy or the violent drug cartels. If the government wants to keep kids off drugs they need to legalize and regulate the drugs. Iv never had a dealer ask for an I.D. that is why i was able to get oz’s of weed and jabs of heroin when i was only 16 easier than i could get a bottle of beer, if that is not proof of a flawed system I don’t know what is.

Oh yes, and I’m a medical patient as well, and I don’t like having to pay an extra $100 a year for being recommended a PLANT by a doctor. MMJ is expensive enough!
I am glad that prop 19 did not pass. This is a good signal that we have conscious citiezens in Calfiornia. I have my 6 years old daughter, and I have started educating her about how bad is to consume drugs (alcohol, marijuana, etc.). You can not legalize a drug that can have devastated results (as any drugs does) in the one who consumes it and their families as well… just because the government need funds to overcome this crisis or to stop durg dealers. To stop drug dealers and related issues, we need to start by educationg our children about the cons of using drugs. We nee to teach them values, so they can take good decisions in life and keep out of drugs. To overcome the crisis, the government has to start incentivating the private sector, wich is the one that generates employment.
