Anna Nicole Smith‘s former manager could be facing a retrial soon. Smith’s boyfriend and former manager, Howard K. Stern, may be heading to court once more.

Vickie Lynn Hogan better known as Anna Nicole Smith died in a hotel room in Hollywood, Florida in February of 2007. After a seven-week investigation, it was revealed that Smith died of “a combination of legal drugs intoxication with the sleeping medication chloral hydrate as the major component.”

In 2010, Howard K. Stern and Smith’s psychiatrist, Dr. Khristine Eroshevich, were found guilty on two charges related to obtaining prescription under a false name.

Stern fought the verdict and was acquitted of most of the 11 counts he faced related to the obtaining of pharmaceuticals for Smith. Los Angeles Superior Court Judge Robert Perry, who dismissed Stern’s case, said it was not unusual in the celebrity world for fake names to be used to protect privacy.

As for Eroshevich, she had all but one of her convictions overturned and was sentenced to a year of probation, and fined $100. But on November 3rd, officials at the California Supreme Court announced that Stern’s case will go back to a criminal judge in Los Angeles.

But is it not certain that Stern will face a retrial. According to experts:

“The ruling only paves the way for prosecutors to ask a judge for a new trial, and if the request is granted, Stern would face a retrial on two conspiracy charges relating to obtaining the prescription drugs.”

Stern’s attorney, Peter Gold, has already stated that he doubts that his client will face a retrial because there is insufficient evidence to convict him. Mr Gold added:

“We look forward to going before Judge Perry to give him the opportunity to grant our motion for a new trial.”

Between the lengthy legal battle over a share of J. Howard Marshall‘s estate and the wild paternity case involving Dannielynn Hope Marshall Birkhead, it seems that Anna Nicole Smith’s life was a succession of losing trials and retrials.
